Welcome to D&J PokePulls LLC's Live Pack Break service! By participating, you agree to the following terms and conditions, so please read them carefully.

1. Agreement: Purchasing a spot in our Live Pack Break events signifies your acceptance of these terms. We may update these terms occasionally, and any changes will be posted on our website.

2. Live Break Process: We'll open all packs live on stream, clearly displaying the contents. "Hit cards" are defined as Double Rare or better cards pulled from the packs. These hit cards will be securely packaged and shipped to the address you provide.

3. Shipping: You are responsible for shipping costs, calculated at checkout. Typical shipping time is within three (3) business days after the live stream. Once the package is with the carrier, we are not responsible for any loss, damage, or delays. Tracking information will be provided when available. We currently only ship within the United States.

4. No Returns: All sales are final. Because of the nature of our service, refunds and exchanges are not offered. If there's an order error or a significant problem during the live break, please contact us within 48 hours of the stream by emailing justin@dandjpokepulls.com.

5. Card Condition: We cannot control factory misprints or damage caused during packaging. We cannot guarantee the condition of cards pulled from sealed packs. We do not guarantee card grading results if you choose to submit your cards for grading.

6. Stream Etiquette: Please be respectful during the live stream. We may remove disruptive viewers without notice. Any fraudulent activity, such as chargebacks, will result in a ban from future events.

7. Age Restrictions: You must be at least 18 years old to participate, or have permission from a parent or guardian.

8. Live Break Schedule: Live breaks are typically scheduled for Wednesdays and Sundays at 9:00 PM Eastern Time (ET), but the schedule is subject to change at any time, for any reason, without notice. Any schedule updates will be posted on our YouTube channel: https://www.youtube.com/@DandJPokePulls

9. Stream Recordings: Live breaks are recorded and available for viewing in our YouTube Live section.

10. Shipping Liability: We are not responsible for issues that occur after your package is given to the shipping carrier, including loss, theft, or carrier-caused damage.

11. Disclaimer of Warranty: The Live Pack Break service is provided "as is" without any warranties of any kind, express or implied, beyond what is explicitly stated in these terms.

12. Limitation of Liability: To the fullest extent permitted by law, D&J PokePulls LLC's liability for any claims arising out of or related to the Live Pack Break service shall be limited to the amount you paid for the specific break. We are not liable for any indirect, incidental, consequential, or punitive damages.

13. Indemnification: You agree to indemnify and hold harmless D&J PokePulls LLC from any and all claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to your participation in the Live Pack Break service.

14. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the State of Texas.

15. Severability: If any provision of these terms and conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
